Abstract

Excessive or unfair pricing by a company holding a dominant position is prohibited under UK competition law as an abuse of dominant position. Excessive pricing cases have been examined only in a limited number of cases over the last four decades. However, recent enforcement activities by the UK Competition and Market Authority (CMA) against excessive pricing in the pharmaceutical sector led to an intense discussion about the appropriate legal standard to tackle unfair pricing.
